			<content:encoded><![CDATA[<p>A bill proposed in Wisconsin has received flak from its critics due to their allegations that such a proposal can cause the lengthening of asbestos-caused mesothelioma claims cases, essentially disabling the ability of courts to award victims before their conditions worsen or they die.</p>
<p>Assembly Bill 19, introduced by DePere State Rep. Andre Jacque, provides discovery and scheduling requirements for a plaintiff filing a personal injury case. The bill mandates that a plaintiff should make it known to a court that he or she is filing a case, with the case only moving forward if the court has decided that there is enough proof of claim. Jacque said the bill is designed to prevent attorneys from “seeking additional awards beyond what fair compensation might be.”</p>
<p>The Assembly Judiciary Committee heard arguments both for and against the bill on Thursday, April 4.</p>

			<content:encoded><![CDATA[<p>A Springfield Township businessman, David Sugar, Sr., will have to pay $850,000 to compensate for the asbestos contamination that his company’s team wrought upon unsuspecting civilians during their demolition of an old steel mill in Steubenville, Ohio.</p>
<p>Sugar, who also violated the law when he bribed ex-Congressman Jim Traficant in 2003, was sentenced by Jefferson County Judge Joseph Bruzzese, Jr. to pay the fine for not taking consideration of the asbestos dispersed in the area when he had the old Weirton Steel plant demolished.</p>
<p>Sugar had already been sentenced to other penalties for other charges related to the case last year, including 15 weekends in jail, three years of probation with house arrest, and a $10,000 fine after admitting guilt to four counts of Clean Air Act violations.</p>

			<content:encoded><![CDATA[<p>New Orleans-based Carol Phillips filed a case against her husband’s former employers in St. John the Baptist District Court for his <a href="http://www.mesothelioma-asbestoshelp.org/articles/losing-a-loved-one-to-mesothelioma/">asbestos-related death</a>. The case was then transferred to a federal court in New Orleans on April 2.</p>
<p>The lawsuit alleges that the victim was exposed to asbestos on a variety of occasions, which led him to develop mesothelioma, eventually leading to his death.</p>
<p>ABB Combustion Engineering Inc., Centerpoint Energy, Inc., Associated Electric Cooperative, Inc., Nebraska Public Power District, and the City of Grand Island were accused of negligence and premises liability for not being able to provide an adequate working environment, not assessing the kind of work Phillips and his co-workers did and not determining whether this was detrimental to their employees’ health or not, and failing to give warnings, proper ventilation, and safety equipment to ensure that asbestos exposure would not be a threat to the workers.</p>

			<content:encoded><![CDATA[<p>A developer has recently plead guilty to asbestos violations that spur from the redevelopment project of a sawmill. The developer stated that he hired an unlicensed contractor in order to demolish an old building and when doing so, asbestos particles were sent into the air near a residential neighborhood.</p>
<p>After this occurred, the site was declared a Superfund by the <a href="http://www.epa.gov/" target="_blank">U.S. Environment Protection Agency </a>and nearly$ 1.6 million was spent in order to clean up the area. When the cleanup process occurred, it was found that there was nearly 4 million pounds of asbestos on the site.</p>
<p>The developer entered a plea deal and was ordered to pay restitution for the cleanup, which totaled to $1.6 million. The 68-year-old man will also complete 300 hours of community service and will be placed on probation for three years. The property featured multiple buildings that had varying degrees of damage.</p>

			<content:encoded><![CDATA[<p>A federal judge recently ruled on an <a href="http://www.mesothelioma-asbestoshelp.org/asbestos/">asbestos case</a> in Chattanooga that was filed against three men who allegedly polluted the city with asbestos fibers during a demolition project at an old textile mill.</p>
<p>The three men faced time in a federal prison for supposedly violating the Clean Air Act. One man has been sentenced to four years in prison, another was sentenced to 20 months, and the last was sentenced to 18 months. Each man and their respective companies were also fined over $20,000 in restitution that must be paid to the Environmental Protection Agency. The three men are supposed to report to prison on November 16.</p>
<p>According to court documents, the demolition project took place between August 2004 and December 2005 and sent asbestos-containing dust throughout the city, mainly residential areas. One man was the property owner, another was the site foreman, and the third man was a demolition contractor. Together they were charged in a 10-count indictment with conspiracy to defraud the U.S.</p>

<p>According to construction crews, the discovery has prompted an extension of the cleanup process at the school.  The remodeling project was supposed to be completed before the school year began, but it is now behind schedule.</p>
<p>Officials with the school have stated that the safety of students and teachers is not at risk, but managing the flow of students within the school is difficult. Fortunately, the  demolition phase that construction crews are currently working on is scheduled to be completed this week, and the next phase is supposed to begin shortly thereafter.</p>

			<content:encoded><![CDATA[<p>A jury in Delaware has recently awarded the family of a mesothelioma victim $2.86 million after their loved one died as a result of exposure to <a href="http://www.mesothelioma-asbestoshelp.org/asbestos/">asbestos fibers</a>.</p>
<p>According to the lawsuit, the man was diagnosed with mesothelioma in August 2010 when he was 62 years old. He passed away the following February.</p>
<p>Prior to his death, the man had worked at Crane Plumbing Fixtures Factory for nearly 4 decades, where he was often required to use talc powder that was contaminated with asbestos. The lawsuit alleged that the label on the talc powder did not sufficiently warn its users of the risks associated with asbestos exposure.</p>
<p>Expert testimony at the trial linked the man&#8217;s asbestos exposure to the talc powder, and the jury sided with his surviving family members. The amount awarded to the victim&#8217;s family is the largest asbestos verdict against a single defendant in Delaware in over ten years.</p>

<p>Hogan&#8217;s Fountain Pavilion is an iconic area of the park, and nearly $45,000 was set aside to renovate the area. 			<content:encoded><![CDATA[<p>A report has recently been released that shows that there is an asbestos issue at Buckingham palace.</p>
<p>According to officials, asbestos was found in multiple areas including  the ducts underneath the floor in the south wing and this removal project is underway. The estimated cost for this is one million pounds.</p>
<p>It has been stated that the entire removal project will take nearly 20 years. The oldest area of the palace were built in the 1700s, but some areas were replaced after a World War II bomb destroyed parts. This was before asbestos was a known carcinogen.</p>

			<content:encoded><![CDATA[<p>Two men were recently indicted on charges of improperly <a href="http://www.mesothelioma-asbestoshelp.org/articles/asbestos-removal-services/">removing asbestos</a> from a former hospital in Riverside.</p>
<p>According to court officials, the two men, ages 53 and 59, were charged with illegally removing <a href="http://www.mesothelioma-asbestoshelp.org/treatment/asbestos/">asbestos</a> without a license, using workers that were not qualified to do so, and failing to use the correct equipment when removing the carcinogenic.</p>
<p>The former hospital is a four story building that was used as a hospital between the years 1935 and 1995 and then a nursing home until 2005. The building was then vacant until its demolition in 2010. The contractors allegedly used inmates and day laborers to do the job and failed to follow state and federal laws that are put in place in order to remove the products safely.</p>
